2. Platform Overview

PocketTip operates a digital tipping platform that enables Customers to make voluntary tips to Service Workers using QR codes and online payment methods.

PocketTip facilitates payments using third-party payment service providers, including Stripe Connect. PocketTip does not operate as a bank, authorised deposit-taking institution, stored-value facility, wallet provider, or other regulated financial institution.

3. Eligibility and Use

You must be at least 18 years old to use the Platform.

You must provide accurate, complete, and up-to-date information when using the Platform and must not use the Platform for any unlawful, fraudulent, or misleading purpose.

PocketTip may suspend or terminate access to the Platform at any time if we reasonably believe these Terms have been breached or the Platform is being misused.

4. Tips Are Voluntary and Final

All tips made through the Platform are voluntary.

By submitting a tip, the Customer confirms that:

• the amount is entered intentionally,
• the payment details are correct, and
• the tip is authorised.

Tips are non-refundable and irreversible, except where required by law or where a refund is mandated by Stripe due to fraud, unauthorised use, or chargeback processes.

PocketTip is not responsible for dissatisfaction with services provided by a Service Worker and does not assess or guarantee service quality.

5. Fees and Charges

PocketTip charges a platform fee and applies payment processing fees. These fees are clearly disclosed to Customers before a tip is confirmed.

PocketTip is not currently registered for GST. No GST is charged on PocketTip fees at this time. PocketTip reserves the right to register for GST in the future and apply GST to fees where legally required, with notice provided through the Platform.

Fees may change from time to time. Continued use of the Platform constitutes acceptance of updated fees.

6. Payments and Stripe Connect

All payments are processed by Stripe via Stripe Connect in accordance with Stripe’s terms and policies.

By using the Platform, you agree to be bound by Stripe’s legal documentation, including:

PocketTip does not control Stripe’s systems and is not responsible for payment delays, failures, reversals, chargebacks, or errors caused by Stripe or other third-party providers.

PocketTip does not hold Customer funds. Funds are processed and settled by Stripe to Service Workers’ nominated Australian bank accounts.

7. Chargebacks, Disputes, and Reversals

Customers acknowledge that chargebacks may result in the reversal of tips.

Service Workers acknowledge that tips may be reversed due to chargebacks, fraud, or unauthorised transactions, and that PocketTip is not responsible for such reversals.

PocketTip may recover reversed amounts, fees, or losses from future payouts or by other lawful means.

8. No Employment or Agency Relationship

Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between PocketTip and any Service Worker.

Service Workers use the Platform independently and are solely responsible for their own services, conduct, and compliance with applicable laws.

9. Tax Responsibilities

PocketTip does not provide tax advice.

Service Workers are solely responsible for determining and meeting any tax obligations arising from tips received, including income tax and GST (if applicable).

PocketTip does not withhold, report, or remit taxes on behalf of Service Workers.

10. Platform Availability

PocketTip does not guarantee continuous, uninterrupted, or error-free access to the Platform.

The Platform may be unavailable due to maintenance, technical issues, security events, third-party failures, or circumstances beyond PocketTip’s reasonable control.

11. Intellectual Property

All intellectual property rights in the Platform, including software, branding, content, and design, are owned by or licensed to PocketTip.

You may not copy, modify, distribute, reverse engineer, or exploit any part of the Platform without prior written consent.

12. Limitation of Liability

To the maximum extent permitted by law, PocketTip is not liable for any loss, damage, cost, or expense (including indirect, consequential, or economic loss) arising out of or in connection with:

• use of or inability to use the Platform,
• tips made or received,
• service quality or conduct of Service Workers,
• payment processing issues,
• chargebacks or reversals, or
• third-party services.

13. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right that cannot be excluded under the Australian Consumer Law.

Where liability cannot be excluded, PocketTip’s liability is limited (at its option) to resupplying the services or paying the cost of resupplying the services.

14. Indemnity

You agree to indemnify PocketTip against any claims, losses, damages, liabilities, costs, and expenses arising from:

• your breach of these Terms,
• your misuse of the Platform,
• your violation of any law, or
• any dispute between Customers and Service Workers.

15. Changes to These Terms

PocketTip may update these Terms from time to time. Updated Terms will be published on the Platform with a revised effective date.

Continued use of the Platform constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of Australia.

You submit to the exclusive jurisdiction of the courts of Australia in relation to any dispute arising under these Terms.
